Manila man sentenced to lengthy prison term
Mary Bernard, Vernal Express

A Manila man convicted of repeatedly drugging and raping a teenage girl was sentenced to serve a minimum of 25 years in prison before being eligible for parole.

Thomas Devirl Curtis, 51, was found guilty in May on four counts of rape and four counts of possession of a controlled substance with intent to distribute, all first-degree felonies.

On Aug. 17, 8th District Judge Clark McClellan handed Curtis a complex sentence of four consecutive and four concurrent terms of five years to life in the Utah State Prison.

McClellan ordered that the prison time on the rape counts run consecutive to each other and prison time for the drug charges to run concurrently, despite a request by prosecutors for all counts to run consecutively.

Curtis was convicted after a two-day jury trial in which the victim testified that she and Curtis, to whom she is related, would use cocaine and then he would have sex with her without her consent.

The victim, who was 16 years old at the time, reported the rapes to Daggett County sheriff’s investigators, who began their investigation in mid-2008.

Curtis, who maintained his innocence throughout the trial, refused to address the court during sentencing because he plans to appeal the ruling. Defense attorney Steven Shapiro asked the court to correct several factual errors in Curtis’ pre-sentencing report because the report will follow Curtis through the appeals process.

Curtis was taken into custody to await transportation to the prison.
